High-fives all around for the women of India! The Supreme Court has ruled that a woman’s character cannot be a defense for the accused, no matter how promiscuous the woman is. "Even a woman of easy virtue has a right to refuse to submit herself to sexual intercourse to anyone and everyone, because she is not a vulnerable object or prey for being sexually assaulted by anyone and everyone," the bench declared.
The court also ruled that the two-finger test violated a victim’s right to privacy, physical and mental integrity, and dignity, and even if a positive test could not confirm that the victim had consented. The court continued to say, “Medical procedures should not be carried out in a manner that constitutes cruel, inhuman or degrading treatment and health should be of paramount consideration while dealing with gender-based violence.”
